Terms of Use<\/strong><\/h1>\n

These Terms of Use (\u201cTerms\u201d) govern your access to and use of the Nightscout Pro Ltd web application and related services (\u201cService\u201d). By subscribing to or using the Service, you agree to be bound by these Terms.<\/p>\n

1. Subscription and Billing<\/h2>\n

The Service is provided on a subscription basis and is billed monthly or annually in advance, depending on the plan selected.<\/p>\n

By subscribing, you authorise Nightscout Pro Ltd to charge your chosen payment method on a recurring basis.<\/p>\n

Subscriptions automatically renew at the end of each billing period unless cancelled before the next billing date.<\/p>\n

You may manage or cancel your subscription at any time via your account dashboard. Cancellation prevents future charges but does not automatically entitle you to a refund.<\/p>\n

\n

2. Digital Service Delivery and Cancellation Rights<\/h2>\n

Nightscout Pro is a digital service that is delivered immediately upon successful payment. This includes account creation, server provisioning, and access to documentation and support.<\/p>\n

By subscribing, you expressly consent to immediate delivery of the digital service and acknowledge that this results in the loss of your 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.<\/p>\n

This does not affect your statutory rights in cases where the service is faulty or not provided as described.<\/p>\n

\n

3. Refunds<\/h2>\n

Refunds are governed strictly by our Refund Policy, available at:
https:\/\/nightscout.pro\/refund-policy<\/use><\/svg><\/span><\/a><\/p>\n

Refunds are not offered as standard and are only considered where required under UK consumer law.<\/p>\n

Refunds are not provided for change of mind, non-use, abandoned setup, or failure to complete configuration without first allowing our support team a reasonable opportunity to assist.<\/p>\n

Nothing in these Terms limits your statutory rights.<\/p>\n

\n

4. User Responsibilities<\/h2>\n

You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out under your account.<\/p>\n

You agree to provide accurate and current information during registration and to keep it up to date.<\/p>\n

You must not share your account with others, resell access, or use the Service for unlawful, abusive, or fraudulent purposes.<\/p>\n

\n

5. Service Availability<\/h2>\n

We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation.<\/p>\n

We may modify, suspend, or discontinue parts of the Service where reasonably necessary, including for maintenance, security, or operational reasons.<\/p>\n

\n

6. Third-Party Services<\/h2>\n

The Service integrates with third-party platforms, devices, and data providers.<\/p>\n

Nightscout Pro Ltd is not responsible for outages, authentication changes, delays, or failures caused by third-party services. Issues arising from third-party providers do not constitute a fault with the Service.<\/p>\n

7. Chargebacks and Payment Disputes<\/h2>\n

If you believe a charge has been made in error, you must contact our support team at support@nightscoutpro.com<\/use><\/svg><\/span><\/a> and allow a reasonable opportunity for investigation and resolution before initiating a chargeback or payment dispute.<\/p>\n

Initiating a chargeback without first contacting support may be treated as misuse of the Service and may result in temporary suspension or termination of your account while the dispute is investigated.<\/p>\n

We reserve the right to dispute chargebacks using relevant evidence, including account access logs, IP addresses, usage records, and communications.<\/p>\n

Payment processing and dispute fees charged by payment providers are non-refundable to Nightscout Pro Ltd.<\/p>\n

\n

8. Termination<\/h2>\n

You may terminate your subscription at any time. Termination does not entitle you to a refund except as outlined in our Refund Policy.<\/p>\n

We may suspend or terminate your access to the Service if you breach these Terms, misuse the Service, or engage in fraudulent or abusive behaviour.<\/p>\n

9. Changes to These Terms<\/h2>\n

We may update these Terms from time to time. Any material changes will be communicated via our website or by email.<\/p>\n

Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.<\/p>\n

10. Governing Law and Jurisdiction<\/h2>\n

These Terms are governed by and construed in accordance with the laws of Scotland, United Kingdom.<\/p>\n

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the Scottish courts.<\/p>\n
