These Terms of Use (“Terms”) govern your access to and use of the Nightscout Pro Ltd web application and related services (“Service”). By subscribing to or using the Service, you agree to be bound by these Terms.

1. Subscription and Billing

• The Service is offered on a subscription basis, billed monthly or annually in advance.

• By subscribing, you authorise Nightscout Pro Ltd to charge your payment method on a recurring basis.

• Subscriptions automatically renew unless cancelled before the next billing cycle.

• You can manage or cancel your subscription at any time via your account dashboard.

2. Refunds

• Refunds are issued in accordance with our published Refund Policy, available at https://nightscout.pro/refund-policy.

• In general, we offer a pro-rata refund for active users and a full refund of the latest month for non-setup or forgotten subscriptions.

• Refunds will not be granted for disputes made without contacting our support team first.

• If you initiate a chargeback or payment dispute without prior communication with our support team, you forfeit any and all rights to a refund.

3. User Responsibilities

• You are responsible for maintaining the confidentiality of your login credentials.

• You agree to provide accurate and current information during registration and to update it as necessary.

• You agree not to share your account with others or use the Service for unlawful purposes.

4. Service Availability

• While we aim for continuous service availability, we do not guarantee uninterrupted or error-free operation.

• Nightscout Pro Ltd reserves the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

5. Data Handling and Privacy

• Your data is handled in accordance with our Privacy Policy, which can be found at https://nightscout.pro/privacy-policy.

• We take reasonable measures to protect your data but cannot guarantee absolute security.

6. Chargebacks and Disputes

• If you believe a charge was made in error, contact us at [email protected] before initiating a chargeback.

• Filing a chargeback or payment dispute without contacting us first constitutes a breach of these Terms.

• In such cases, your account may be suspended or terminated, and you may be required to pay an administrative fee (equivalent to the dispute fee incurred by us) to restore service.

• You will also lose any and all rights to a refund if a chargeback is filed without prior contact.

• We reserve the right to dispute chargebacks with evidence including login records, IP logs, and communications.

7. Termination

• You may terminate your subscription at any time. Termination does not entitle you to a refund beyond the scope of our Refund Policy.

• We may suspend or terminate your account if you violate these Terms, misuse the Service, or initiate fraudulent disputes.

8. Changes to Terms

• We may revise these Terms from time to time. Changes will be communicated via email and on our website.

• Continued use of the Service after changes constitutes acceptance of the revised Terms.

9. Governing Law

• These Terms are governed by and construed in accordance with the laws of Scotland, United Kingdom.

• Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
